These conditions (from now on, “Conditions of Use”) rule the permited use of the Web page with URL http://www.autosvalls.com (from now on, “the Web page”), that AUTOS PUNTA PRIMA S.L. with head office in Plaza España 13, 07702 Mahón Menorca (Spain), inscribed in the Mercantile Record of Minorca, in the volume 33, foliate 213, page number IM-1748 and CIF B07768369 (from now on “Autos Valls”), puts to the Internet user (from now on, “The user”).
The user’s access to the Web page implies that

2.1 The rights of intellectual property of the Web page, its source code, design, structure of navigation, photographies, databases and the different elements contained in it are Autos Valls’ ownership. To Autos Valls corresponds the exclusive exercice of the rights of exploitation and, in particular, the copyrights, distribution, public communication and transformation rights.
2.2 Autos Valls is the holder of the rights of industrial property as for the identificative names of the services offered, and in particular as for the name Autos Valls on which it has all the rights of disposition. Its use is therefore forbidden without the previous and express agreement of Autos Valls.
2.3 The visualization, printing and partial download of the content of the Web page are authorized in the following conditions:
a) Compatibility with the Web page’s purposes.
b) That the intention is to obtain the information for personal and private use. It is expressly prohibited to use the information for commercial purposes or for its distribution, public communication, transformation etc.
c) That none of the Web page contents suffer any kind of modification.
2.4 Autos Valls reserves the right to act against any of the user’s action that is contrary to what is stipulated in this clause and against any activity that is contrary to the laws, the morality and the public order. Any unauthorized use of the information contained in the Web page and damage of the Intellectual or Industrial Properties will give place to legally established responsibilities.
Autos Valls reserves the faculty to proceed to modifications and updates of the information, configuration and presentation of the Web page and of the Conditions of Use. Such modifications and updates can be done at any time and without need of previous notice.
4.1 Autos Valls does not guarantee the nonexistence of interruptions or mistakes in the access to the Web page or to its content, nor that the latter is updated. As soon as Autos Valls receives news of such problems, and providing that no reason make it impossible or difficult to execute, it will carry out all those tasks to repair the mistakes, restore the connection an update the contents.
4.2 The access to the Web page and the unauthorized use its information is of the user’s responsibility. 4.3 Autos Valls does not take on the responsibility for the contents of the linked Web pages, providing that the latter are not Autos Valls’ property. It does not guarantee either the absence of virus or other elements that could produce alterations to the IT system (hardware and software) or to the user’s documents or files; Autos Valls therefore rules out any responsibility for damages caused for this motive.
The user shall inform Autos Valls in case he thinks that the content or the services offered by the linked Web pages are illicit or damage goods or rights of a customer or of a third party and that such damage might lead to an indemnification. And that especially if the mentioned contents consist in:
a) Activities or contents that could be considered as punishable by the penal Spanish regulation.
b) Activities or contents that violate rights of intellectual or industrial property.
c) Activities or contents that could endanger the public order, the penal investigation, the public safety and the national defense.
d) Activities or contents that could endanger the protection of the public health, with regard to the person’s dignity and the principle of non-discrimination and the protection of the health and the infancy.
4.4. Any link of third parties to the Web page shall be requested and authorized by Autos Valls beforehand. In any case, such links will be done in Autos Valls’ principal Web page. It is expressly prohibited to create “deep links”, “framing” or any other utilization of the contents of the Web page in favour of unauthorized third parties.
These Conditions of Use are ruled by the Spanish legislation. To solve any controversy or conflict that could stem from it, Autos Valls submits to the criteria of competencial determination established in the applicable legislation on consumers and users.
